LEGAL

Terms & Conditions

The basis on which Brassdale offers courses and the responsibilities of both parties.

Last updated: 1 January 2025

OVERVIEW

These Terms and Conditions govern the use of the Brassdale website and the enrolment in and delivery of Brassdale courses. They apply to all visitors to our website and to individuals who register for any course offered by Brassdale. By using our website or enrolling in a course, you agree to these terms.

Brassdale is a financial education provider registered in Malaysia and operating from 102 Jalan Tun Razak, 50400 Kuala Lumpur. We are not a licensed financial adviser, investment manager, or insurance intermediary. Nothing in our courses constitutes financial advice.

SECTION 01

Nature of Our Courses

Brassdale provides financial education — that is, courses intended to improve participants' understanding of financial topics relevant to their personal or business circumstances. Our courses are not, and should not be understood as:

  • Financial advice or investment recommendations tailored to your personal situation.
  • Legal advice on any matter, including estate planning, succession, or contract law.
  • Tax advice or guidance on specific tax matters applicable to your circumstances.
  • Insurance advice or recommendations regarding specific products.

Course content reflects our understanding of Malaysian financial matters as at the time of writing and is updated periodically. Participants are encouraged to consult qualified professionals before making significant financial or legal decisions.

SECTION 02

Enrolment and Payment

Enrolment in a Brassdale course is confirmed once full payment has been received. Prices are as listed on our Courses page and are quoted in Malaysian Ringgit (RM) inclusive of any applicable taxes.

  • Payment must be made in full prior to the commencement of the course unless a specific arrangement has been agreed in writing.
  • Brassdale reserves the right to adjust course fees for future enrolment periods. Fees in effect at the time of your booking will apply to your enrolment.
  • Your place is personal and non-transferable except with our prior written agreement.
  • We may decline an enrolment where a course is fully subscribed or where we reasonably consider the course unsuitable for the applicant's stated circumstances.

SECTION 03

Cancellation and Refunds

We understand that circumstances change. Our cancellation terms are as follows:

  • More than 14 days before course commencement — a full refund will be issued, less any payment processing fees charged by our provider.
  • Between 7 and 14 days before commencement — a 50% refund will be issued.
  • Fewer than 7 days before commencement — no refund will be issued, though we may, at our discretion, offer a transfer to a later course delivery.
  • Once a course has commenced — no refund will be issued for sessions already delivered.

If Brassdale cancels a course before commencement, a full refund will be issued to all enrolled participants within 14 days.

If Brassdale is required to reschedule a course, participants will be offered either a transfer to the revised dates or a full refund.

Refund requests should be submitted to [email protected] and will be acknowledged within two working days.

SECTION 04

Course Delivery

Brassdale courses are delivered as described on the Courses page at the time of enrolment. Delivery formats may include scheduled live sessions (online or in-person), pre-recorded materials, and downloadable worksheets or templates.

  • We reserve the right to make reasonable adjustments to course content, format, and schedule where circumstances require. We will notify participants of material changes in advance where practicable.
  • Access to downloadable course materials is provided for the duration of the course and for a period of 12 months thereafter.
  • Where sessions are conducted live, participants are expected to attend at the scheduled times. We do not guarantee the availability of recordings for missed sessions, though we will make reasonable efforts to provide them.
  • Course facilitators and content contributors may change between delivery cycles. We ensure that the educational quality and accuracy of content is maintained regardless of delivery personnel.

SECTION 05

Intellectual Property

All content produced by Brassdale — including course materials, worksheets, templates, written guides, slide presentations, and website content — is the intellectual property of Brassdale or its contributors.

  • Course materials are provided for the personal educational use of enrolled participants only.
  • Materials may not be reproduced, distributed, resold, or adapted without our prior written permission.
  • Sharing access credentials or course materials with individuals who are not enrolled is not permitted.
  • The Brassdale name, logo, and brand elements are proprietary and may not be used without written consent.

If you wish to use our materials for purposes beyond personal study — for example, as part of a workplace training programme — please contact us to discuss arrangements.

SECTION 06

Participant Conduct

Brassdale courses are attended by adults who come to learn in a thoughtful, considered environment. We ask all participants to:

  • Engage respectfully with facilitators and other participants.
  • Refrain from disruptive behaviour during live sessions.
  • Not record live sessions without the prior consent of all parties present.
  • Maintain the confidentiality of personal financial information shared by other participants in discussion.

Brassdale reserves the right to remove a participant from a course where conduct is deemed harmful to others or to the integrity of the programme. In such cases, no refund will be issued.

SECTION 07

Limitation of Liability

Brassdale takes care in the preparation and delivery of its educational content. However, to the extent permitted by Malaysian law:

  • We are not liable for any financial loss, investment decision, or other outcome arising from your application of course content to your personal circumstances.
  • Course content is educational in nature and does not account for individual circumstances. It is not a substitute for professional financial, legal, or tax advice.
  • We do not warrant that course content is free of error or that it will remain current beyond the date of its last revision.
  • Our total liability to any participant in connection with a course is limited to the fees paid for that course.

Nothing in these terms limits liability for fraud, personal injury caused by negligence, or any matter that may not lawfully be excluded under Malaysian law.

SECTION 08

Website Use

You may use our website for lawful purposes and in accordance with these terms. You must not:

  • Use the website in any way that is unlawful, harmful, or fraudulent.
  • Attempt to gain unauthorised access to any part of the website or its underlying systems.
  • Transmit any unsolicited commercial communications through the website.
  • Introduce malware, viruses, or any harmful software.

Our website may contain links to third-party websites. We do not endorse or accept responsibility for the content or practices of those sites.

We make reasonable efforts to keep the website available and accurate, but do not guarantee uninterrupted access or the absence of errors.

SECTION 09

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

We are committed to resolving any concerns or disputes through open communication. If you have a concern, we encourage you to contact us in the first instance. We will make every reasonable effort to reach a fair resolution before any formal process becomes necessary.
